Lok Sabha passes triple talaq Bill; Congress and other parties go along

Women's rights activists have pointed out that the penalising might discourage reporting of instant triple talaq, or worse still, may lead to desertion of the wife by the husband without technically giving instant triple talaq. An employee of the Railways, she has approached the Supreme Court against the practice of polygamy. He said the government has brought in the bill on the suggestion of the Supreme Court, which had banned instant triple talaq in August.

Meanwhile, the passed bill will now be introduced in the Rajya Sabha for passage before it is forwarded to the President for signing it into a law. Although the legislation will now have to be cleared by the Upper House of Parliament.

Mallikarjun Kharge, the leader of the Congress in the House, and several other MPs of the opposition parties, demanded that it should be sent for vetting by a parliamentary standing committee. The Bill also seeks to entitle a woman to get the custody of her minor children as well as subsistance allowance from her husband in case he pronounced the Triple Talaq on her.

The bill states that the commission will have government nominated chairman and members, and the board members will be selected by a search committee under the Cabinet Secretary. The government, however, pushed the Bill through, as Speaker Sumitra Mahajan accepted the Law Minister's request to allow it to be considered and passed on Thursday itself.

The Supreme Court in August had declared the practice of instant triple talaq unconstitutional. "Will the government create a corpus to provide maintenance to divorced women waiting for compensation?"

Health officials: 6 Oklahomans have died from the flu this season

Muslim men, especially the mullahs, who have thrived on male superiority, were greatly resentful but could do little before a bill came up in the Parliament to formally legislate the ban that the apex court had decreed was needed to be done within six months.

Members of the All India Muslim Personal Law Board said the government had no right to outlaw instant triple talaq, as it was directly interfering with Muslim personal law.

On the other hand, All India Majlis-e-Ittehadul Muslimeen (AIMIM) head Asaduddin Owaisi exhorted that the Triple Talaq bill "violated the fundamental rights of Muslims".

"If this new law is implemented in true spirit then it will go a long way and prove to be a deterrent for the husbands from saying "talaq-e-biddat" to their wives", she said. "While the Bill talks only about Muslim women being abandoned, the Government should also worry about almost 20 lakh women of various religions who are abandoned by their husbands, "including our bhabhi from Gujarat", he said, making a veiled reference to Prime Minister's wife Jashodaben".

Muslims are the biggest religious minority in Hindu-majority India and relations between the communities have sometimes been strained since Prime Minister Narendra Modi and his Hindu-nationalist Bharatiya Janata Party won a 2014 election.
