Mr Peterson, a Republican member of the Federal Election Commission, is the latest of Mr Trump's conservative judicial nominations to fail.

Kennedy went on to question Petersen on when the last time he read the Federal Rules of Civil Procedure. Secondly, Kennedy was one of the Senate Republicans who warned the White House about serious issues surrounding nominee, Brett Talley of Alabama, as to his truthfulness and inexperience for the federal bench. I believe the American Bar Association's Standing Committee on the Federal Judiciary was correct when it unanimously rated him as "Qualified".

Mr Trump's critics were vocal following the Senate hearing, claiming the president was not focusing on qualifications for his nominees.

The Senate has confirmed 20 judges starting with Gorsuch, including 12 to powerful appeals courts that are the last stop before the Supreme Court - more than any president has achieved in his first year in office. The conversation between Kennedy and five nominees, including Petersen, went as such: "Have any of you not tried a case to verdict in a courtroom?" Kennedy told a Louisiana TV station that Trump called him on Saturday, the day after the clip of Petersen was tweeted by Democratic senator Sheldon Whitehouse before ricocheting around the internet.

Kennedy said Trump has also told him that he's counting on senators to reject his bad judicial picks. This ultimately led the White House to withdraw its nomination.
